1. Acceptance of these terms

By accessing or using this website, you agree to these Terms and Conditions and our Privacy Policy. If you do not agree, do not use the website. Additional written agreements may apply if you become a FORGEN GROWTH client; if those agreements conflict with these website terms, the written client agreement controls for the services it covers.

2. Website and services

FORGEN GROWTH provides growth, advertising and related consulting services for roofing and home-improvement companies. Website content and strategy calls are provided for general business information and evaluation. Specific deliverables, pricing, eligibility requirements, responsibilities, guarantees and performance terms apply only when stated in a separate written agreement signed by the applicable parties.

Submitting a form or booking a call does not create a client relationship or obligate either party to purchase or provide services.

3. SMS messaging terms

Program name and purpose. The FORGEN GROWTH SMS program sends promotional messages about FORGEN GROWTH services, offers, updates and opportunities to schedule a strategy call to contacts who opt in through the appointment booking form.

Opt-in. You enroll only by affirmatively selecting the marketing-consent checkbox in the FORGEN GROWTH appointment booking form and submitting that form. Consent is specific to FORGEN GROWTH, is not transferable and is not a condition of purchasing goods or services. Forms that do not include this checkbox do not enroll you in promotional SMS messaging.

Frequency and charges. Message frequency varies based on your appointments, requests and consent selections. Message and data rates may apply according to your mobile plan. Carriers are not liable for delayed or undelivered messages.

Opt-out and help. Reply STOP to any message to opt out. After opting out, you may receive one confirmation message and then no further messages from that program unless you opt in again. Reply HELP for assistance, call or text 480.694.2288, or use the contact information below.

Privacy. We handle mobile information and SMS consent as described in our Privacy Policy. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

4. Intellectual property

The website and its text, graphics, branding, layout, videos and other content are owned by FORGEN GROWTH or used with permission and are protected by applicable intellectual-property laws. You may use the website for your internal evaluation of our services, but may not reproduce, distribute, commercially exploit, scrape or create derivative works from it without permission.

5. Acceptable use

You may not misuse the website, attempt unauthorized access, interfere with its operation, introduce malicious code, submit false or unlawful information, impersonate another person, or use the website in a way that violates applicable law or the rights of others.

The website uses or links to third-party services, including scheduling, customer-relationship, communications, analytics and video platforms. Their availability and practices are outside our control and may be governed by their own terms and privacy notices.

These terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Any dispute relating solely to these website terms will be brought in a court of competent jurisdiction located in Arizona, unless applicable law requires otherwise.

We may update these Terms and Conditions as our website, services or legal obligations change. The date at the top shows when they were last updated. Continued use of the website after an update means you accept the revised terms.
